Design Work and Logo Design
These Terms and Conditions provide the basis for a good working relationship between GARETH EDWIN and you (the Client). 
These Terms and Conditions also form an integral part of the agreement between GARETH EDWIN and the Client.
Section 1: Design work by GARETH EDWIN
Design work refers to any and all work undertaken by GARETH EDWIN to create a digital design for printing, use on websites and/or social media platforms. All new design work carries its own specific job reference for identification between different projects (e.g. GE_12345).
1.1: Cost for design work is either based on an hourly rate, or established through a supplied estimate, based on a working brief (set of instruction outlining any requirements) from the client, or drawn up by GARETH EDWIN on behalf of the client and presented with a supplied estimate.
1.1.1: Estimates based on a working brief are subject to change based on the following:
• The requirement of extra work beyond that established in the working brief.
• The working brief changes to the point where the design is required to be started from the beginning.
• The amount of proofs exceeds the number stipulated for the work/project.
1.2: Copyright law assigns full ownership of any and all design work, including working files and assets (files used to create the design and edit), to GARETH EDWIN. The client is supplied with a print-ready document and the original digital documents are retained by GARETH EDWIN.
1.3: Transferring Copyright ownership to the customer is available via a written agreement determining the value of the working files and assets of the design created by GARETH EDWIN. The final value, of the copyright ownership, is negotiable and can be based on the total of the final invoice and may only be established, changed or modified in writing with the approval of both parties.
1.4: Beyond the transfer of copyright ownership GARETH EDWIN reserves the right to display the final artwork design for both online and offline portfolios for the sole purposes of promoting services supplied by GARETH EDWIN.
Section 2: Logo design by GARETH EDWIN
Logo design refers to design undertaken to create a graphic mark, emblem, or symbol used to aid and promote public identification and recognition for an individual, organisation, or business. All new logo design work carries its own specific job reference for identification between different projects (e.g. GE_12345).
2.1: Cost for logo design work is either based on an hourly rate, or established through a supplied estimate based on a working brief (set of instruction outlining any requirements) from the client, or drawn up by GARETH EDWIN on behalf of the client and presented with a supplied estimate.
2.1.1: Estimates based on a working brief are subject to change based on the following:
• The requirement of extra work beyond that established in the working brief.
• The working brief changes to the point where the design is required to be started from the beginning.
• The amount of proofs exceeds the number stipulated for the work/project.
2.2: The Copyright of the final logo design will be transferred to the customer on full payment.
2.3: GARETH EDWIN retains the right to display the final logo design for both online and offline portfolios for the sole purposes of promoting services supplied by GARETH EDWIN.
Section 3: Client use of final artwork by GARETH EDWIN
• On completion, the client is supplied with a print-ready document and/or web-ready image as specified in a working brief.
• The client is free to use and reproduce the final artwork and will not be restricted by the copyright ownership that applies to the design work, as outlined in Section 1 and 2.
• Any licence that may be required to limit copies and in which media the final artwork can be used will be outlined in a working brief under the heading ‘Artwork Licence’. Any such licence that may be implemented will be established in writing with the approval of both parties.
Section 4: Extra services provided by GARETH EDWIN
Extra services refers to extra work required beyond the original working brief, or services requested beyond the scope of design work, which are listed below alongside any costs or surcharges that apply:
• Modifications, or editing, to supplied artwork - Costed at hourly rate, or established by an estimate based on a working brief.
• Researching and sourcing assets and/or goods from a third party for purchase on behalf of a client - Costed at hourly rate, or established by an estimate based on a working brief. Any and all goods purchased are subject to a 25% surcharge, based on the original cost of goods, alongside any postage and packaging
costs incurred.
Section 5: Payment to GARETH EDWIN
On release of the completed artwork/design/logo a final invoice for any and all outstanding costs will be submitted to the client. Payment terms are also displayed on the client’s final invoice.
5.1: Deposits may be required, or can be submitted, with the approval
of both parties. An invoice will be supplied for any deposits. The final invoice will note any previously received deposits/payments made towards the design work/logo design/project and will include the specific job reference (e.g. GE_12345).

5.1.1: For Design work/logo design/a project, with a specific job reference, which runs beyond a time period of 28 days after the 1st proof, an invoice based on one of the following stipulations will be submitted to the client for payment, following an email notice of the elapsed time period:
• An invoice for 50% of hours undertaken up to the point of the 1st proof, based on the hourly rate for GARETH EDWIN.
• An invoice for 50% of the job reference estimate supplied to the client by GARETH EDWIN.
• Neither stipulation applies if a deposit of 50% or more has been paid in advance towards the specific job reference.
5.2: Payment of a final invoice should be paid within 30 days of the date of Invoice.
5.2.1: Late payment will incur a penalty fee of £40.00 as well as a standard 8% interest charge over the Bank of England base rate for each day over the final date of payment (30 days after date of Invoice).
5.2.2: Efforts will be made by GARETH EDWIN to remind clients of any pending charges and overdue payments, but will not be held responsible for unpaid invoices due to issues, either technical, clerical and/or managerial, on the side of the client.
